Terms of Service — Pattibytes Express

Please read these Terms of Service ("Terms") carefully before using the Pattibytes Express app operated by Pattibytes ("Company", "we", "us", "our").

By downloading, registering, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

1. Eligibility

• You must be at least 18 years old to use this App independently.
• By using the App, you represent that you are 18 or older and have the legal capacity to enter into a binding contract under the Indian Contract Act 1872.
• Users between 13 and 17 years of age may use the App only under the direct supervision of a parent or legal guardian who accepts these Terms on their behalf and whose consent has been verified.
• We do not knowingly allow children under 13 to create accounts. If we discover a user is under 13, we will immediately delete their account and associated data.

2. Account Registration

• You must register for an account to place orders.
• You must provide accurate, current, and complete information during registration.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• Notify us immediately at pbexpress38@gmail.com of any unauthorised access or security breach.
• We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.
• Your account is personal to you and may not be transferred or sold to another person.

3. Account Deletion

You may delete your account at any time from within the App via Profile → Settings → Delete Account. Upon deletion:

• Your account access will be revoked immediately.
• Your personal data will be deleted within 30 days, except data we are legally required to retain (e.g., order history for GST compliance).
• You will receive an email confirmation once the deletion is complete.
• Any active orders at the time of deletion must be completed or cancelled first.

4. Placing Orders

• Orders placed through the App are subject to acceptance by the restaurant.
• We are a technology platform connecting customers with restaurants; we are not a restaurant or food manufacturer and take no responsibility for the quality, safety, or content of food prepared by restaurants.
• Menu items, prices, and availability are set by individual restaurants and may change without notice.
• Once an order is accepted by a restaurant, a binding contract is formed between you and the restaurant for that order. Pattibytes is not a party to that contract.
• Estimated delivery times are estimates only and are not guaranteed. We are not liable for delays caused by traffic, weather, or other circumstances beyond our control.
• We reserve the right to cancel or refuse any order we reasonably suspect to be fraudulent or in violation of these Terms.

5. Pricing and Payment

• All prices are displayed in Indian Rupees (INR) inclusive of applicable taxes (GST).
• Payment methods available are displayed at checkout and may change from time to time.
• Your payment is processed by our third-party payment partner. We do not store your full card details or CVV at any time.
• In the event of a payment failure, your order will not be placed. Contact support if you are charged without a confirmed order.
• We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time of checkout.

6. Cancellations and Refunds

• Orders may be cancelled within 5 minutes of placement, provided the restaurant has not yet accepted the order.
• Once a restaurant begins preparing your order, cancellation may not be possible.
• In the event of a cancellation by the restaurant or a delivery failure attributable to us, you will receive a full refund.
• Refunds for eligible cancellations are processed within 5–7 business days to your original payment method.
• Refunds will not be issued for orders cancelled due to incorrect delivery addresses provided by you, or refusal to accept delivery.
• For disputes related to food quality or order accuracy, please contact us within 24 hours of delivery at pbexpress38@gmail.com.

7. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of applicable Indian law
• Submit false, misleading, or fraudulent information — including delivery addresses or payment details
• Place orders with no genuine intention of accepting and paying for them
• Abuse, exploit, or attempt to circumvent promotional codes, discounts, or referral programs
• Harass, threaten, abuse, or harm delivery partners, restaurant staff, or other users in any way
• Attempt to reverse-engineer, decompile, hack, or disrupt the App or its infrastructure
• Scrape, crawl, or extract data from the App using automated tools
• Create multiple accounts to gain unfair advantage or circumvent bans

Violation of any of these rules may result in immediate account suspension or permanent termination and, where applicable, referral to law enforcement.

8. Reviews and User-Generated Content

• Reviews you submit must be honest, accurate, and based on your genuine personal experience.
• Reviews must not be defamatory, abusive, obscene, or constitute a personal attack on any individual.
• We reserve the right to remove reviews that violate these standards without prior notice.
• By submitting content (reviews, photos, or other material), you grant Pattibytes a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use that content within the App and for promotional purposes.
• You confirm that you own or have the rights to any content you submit.

9. Intellectual Property

The App, including its name, logo, design, source code, content, and underlying technology, is owned by Pattibytes and is protected by copyright, trademark, and other intellectual property laws of India.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, reproduce, or distribute any part of the App without written permission
• Use our name, logo, or branding without prior consent
• Create derivative works based on the App

10. Third-Party Services

The App integrates third-party services including Google Sign-In, Apple Sign-In, payment processors, and mapping services. Your use of those features is also subject to those third parties' terms of service and privacy policies. We are not responsible for the actions or content of any third-party service.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable Indian law, the App is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be uninterrupted or error-free
• Any defect will be corrected
• The App or the server making it available are free of viruses or harmful components

12. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or inability to use it.
• Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the App shall not exceed the amount you paid for the specific order directly giving rise to the claim.
• We are not liable for any delays, failures, or damages caused by events beyond our reasonable control (force majeure), including acts of government, natural disasters, strikes, or internet disruptions.
• We are not liable for the quality, safety, or content of food prepared by restaurant partners.

Nothing in these Terms limits our liability for fraud, gross negligence, death, or personal injury caused by our negligence.

13. Indemnification

You agree to indemnify and hold harmless Pattibytes, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your use of the App in a manner not authorised by these Terms
• Your violation of any third-party rights

14. Grievance Redressal

In accordance with the Information Technology Act 2000 and the DPDP Act 2023, we have designated a Grievance Officer:

We will acknowledge your complaint within 48 hours and aim to resolve it within 90 days as required under the DPDP Rules 2025.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act 1872 and Consumer Protection Act 2019.

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Punjab, India.

16. Changes to These Terms

We may update these Terms at any time. For material changes, we will notify you via in-app notification at least 15 days before the changes take effect.

For non-material changes (e.g., corrections, clarifications), we will update the "Last updated" date.

Continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Pattibytes regarding your use of the App and supersede all prior agreements.
